SALES CONDITIONS

These general conditions (the “General Conditions” ) rule the way and the sale terms of the goods sold by Equitec International srl s.r.l.(the goods).

All sale contracts of goods from Equitec International srl to a customer are ruled by these terms and conditions, which are the most important part of each proposal, order or purchase order confirmation of the goods.

Terms and conditions of your order are those in force to the date of it.

1. Goods: Prices and technical characteristics

1.1 The prices of goods sold on line by Equitec International srl are inclusive of all charges except when it is differently specified. New goods prices cancel and replace the former prices and they depend on goods real availability. Equitec International srl reserves the right, by giving notice to the customer at any time before delivery, to confirm or increase the price of goods on its website.

1.2 All technical characteristics for goods, advertised by Equitec International srl, are from respective producers. Equitec International srl is not responsible for those information. Except when it is differently specified, information and software of goods are in English: Photos of goods are only demonstrative.
Goods cannot tasted. Even if all Equitec International srl’s workers can give all indications about them. Customers are responsible about their choices about ordered goods, considering the producers’ information .

2. Order invoicing

2.1 Shopping order of goods to Equitec International srl shell be full in any part to be easily identified. Provided that acknowledgment of the customers’ order is a contractual acceptance.

2.2 Equitec International srl reserves the right not to accept the order when it is incomplete, not well filled up with all customer’s information. If the order will not be delivered by Equitec International srl, It will inform the costumer and will give back money, if the customer has given money for it. In any case the customer will not be entitled to any compensation.

2.3 The invoicing will be send to the customer by Equitec International srl with the delivered goods. When the customer wants an own name invoicing will have to indicate the opportunity. Equitec International srl is not responsible otherwise.

3. Delivery

3.1 All delivery costs are charged to the customer. Deliveries are made by GLS Executive. When goods are sent cash on delivery, goods will be delivered only after the payment of them by cash, or by cheque registered under  Equitec International srl . Equitec International srl reserves the right to deliver goods with a different carrier from Executive or any other means of transport.

3.2 The date for delivery quoted by Equitec International srl is reserved to goods that are stored, and even if they are well valued, Equitec International srl is not responsible about it, in fact Equitec International srl can confirm or change them, following its storage. Any late in delivery, less than 30 (thirty) days, doesn’t give right to the customer to refuse it and not to have any indemnity.

3.3 Equitec International srl reserves the right to deliver goods (pertinent to the same order) in different dates, even if the customer will pay only one carriage.

3.5 Different terms of delivery must be agreed before between the customer and Equitec International srl and accepted by Equitec International srl in writing.

4. Special offers and gifts.

4.1 Any possible special offer encouraged by Equitec International srl will be valid until the exhausting of goods. They aren’t cumulative and they could be in special packing. ( package or online instructions etc)

4.2 When the customer has the right to receive a gift with the goods he bought, he will receive it only if he has demanded for it in his order and in order to Equitec International srl’s stock in hand.

4.3 No assistance or replacement is given for gift from Equitec International srl.

5. Warranties and technical service.

5.1 Equitec International srl warrants that the goods will be fully functioned for their purposes at the time of delivery(see the following Equitec International srl’s conditions of guarantee). Problems warranted by Equitec International srl’s conditions of guarantee must be notified before 10 (ten) days from the delivery date. Damaged goods can be replaced only with the return of those malfunctioned in order to Equitec International srl’s conditions of guarantee. The customer hasn’t the right to any compensation for damages. Equitec International srl the cost for the new delivery.

5.2 In respect with 5.1 article, Equitec International srl doesn’t give a more warranty than that the producers give. Technical service and warranty are done, where it is established, by the producers following the conditions of guarantee of producers’ instructions. If the customer will use goods in a different way from that specified by terms of utilization, Equitec International srl will be not responsible.

5.3 Except in respect of personal injury caused by Equitec International srl, it is settled, that even if it is established Equitec International srl’s responsibility in comparison with the customer, also in case of total or in part non- execution of the duties assumed from Equitec International srl with the customer, because of the execution of an order; Equitec International srl’s responsibilities shall not exceed the price of goods bought by the customer and for he has contested,

6. Customer’s right of return

6.1 In order with the law of 22 may 1999 n.185 the customer(only when it’s possible to qualify him as a customer.Ar.1 letter B) shall be entitled to return ordered goods to Equitec International srl within 10 (ten)working days of receipt for a full refund without specifying grounds.

6.2 The customer’s right of return(see the previous law) must be made, not to lose the right, sending a registered to Equitec International srl  Via di Torre S. Anastasia 83 – 00134 Roma, within 10 (ten) working days of receipt of goods. The communication of return can be sent by a telegram or a fax to Equitec International srl’s telephone number +39.06.71355285, but the customer must confirm it with a registered letter within 48 (forty eight ) hours following the telegram or fax.

6.3 All goods must be returned in a condition and with accessories identical to those supplied, included the original package, and Equitec International srl must authorize the return and it gives an authorized number RMA, When the customer will receive the number RMA , he can send the good to this address : Equitec International srl Via di Torre S. Anastasia, 83 – 00134 Roma - Italy. Equitec International srl doesn’t accept a cash and delivery package.

6.4 When Equitec International srl will receive back the goods(and checked their entireness) Equitec International srl will be back the money to the customer for returned goods(as in bill) except for the delivery costs, which are definitively charged to the customer.

7. Data Security

All the financial customer's information (such as per credit cards etc.) they are not from us preserved in some way after the payment.

8. Competent court.

When the laws of protection of the customer can be enforced( see the ar:1letterB of the law of 22 may 1999 nr.185) every controversy, joined to Equitec International srl’s terms and conditions will be governed by Rome (Italy) Court.

According to the laws 1341 and 1342 of the civil law the customer declares to have read and understood and to accept the following clauses of Equitec International srl terms and conditions: 1.1,1.2,2.1,2.2,3.2,4.1,4.2,4.3,5.1,5.2,5.3,6.2,6.3,6.4 and 7.
